Every child deserves to feel safe. In the immigration system, safety means having an attorney by your side. But recently, the Trump administration eliminated legal representation for 26,000 children on March 21, 2025.

That’s why ImmDef, along with co-counsel organizations Amica Center for Immigrant Justice and Justice Action Center , sued the government to protect children’s rights on behalf of 11 plaintiff organizations. The goal of Community Legal Services in East Palo Alto v. HHS (CLSEPA v. HHS) is to return to the status quo and restore legal representation for unaccompanied children. 

On February 18, 2025, the U.S. Department of Health and Human Services (HHS) suddenly told 86+ nonprofit legal organizations nationwide that they were no longer allowed to proceed with offering legal education, legal consultations, or legal representation for unaccompanied children through a stop-work order.

 

These children—many of whom are fleeing violence, trafficking, or extreme poverty—would be left to face immigration court all alone. After 72 hours, the stop-work order was rescinded thanks to public pressure.

 

On March 21, 2025, the Trump administration officially eliminated legal representation.

Without a lawyer, children have almost no chance of presenting and winning a complex asylum case. They are allowed to remain here less than 10 percent of the time.

 

This decision was cruel, unfair, and a clear violation of federal law under the Trafficking Victims Protection Reauthorization Act (TVPRA).

What's Happening?

On March 27, 2025, legal service providers sued the Trump administration to protect children’s rights in immigration court. The court granted an emergency Temporary Restraining Order (TRO) on April 1, 2025. On April 4, 2025, the Trump administration sought to dissolve the TRO, and in response the judge requested a status report on compliance with the order by April 8. The government’s leisurely response to an emergency situation has placed tens of thousands of children in harm’s way.  Co-counsel and plaintiffs are fighting against a clear violation of federal law under the Trafficking Victims Protection Reauthorization Act (TVPRA) and demand the return to the status quo while litigation continues.  

  

Organizational plaintiffs in the suit include Amica Center for Immigrant RightsCommunity Legal Services in East Palo AltoEstrella del Paso, Florence Immigrant & Refugee Rights Project, Galveston-Houston Immigrant Representation Project, Immigrant Defenders Law Center, National Immigrant Justice Center, Northwest Immigrant Rights Project, Rocky Mountain Immigrant Advocacy Network, Social Justice Collaborative, and Vermont Asylum Assistance Project. Plaintiffs are represented by the Amica Center for Immigrant Rights, Immigrant Defenders Law Center, and Justice Action Center.

 

The emergency temporary restraining order is an important  first step, but it’s just the beginning. We’re continuing to fight to make sure children are never again left alone in court.

“I urge you to take immediate action to defend the Unaccompanied Children Program, which has provided vital legal services and direct representation to some of the most vulnerable children. This program has supported 26,000 unaccompanied children with direct legal representation, legal orientations, and other services for over 100,000 children annually. However, the government ended funding for this critical program, leaving children alone to defend themselves against a highly trained ICE attorney.

 

This program’s funding has historically benefitted from bipartisan support since 2003. Congress is responsible for defending the rights of children. Legal aid is more critical than ever due to ongoing ICE enforcement. It is virtually impossible for a child to understand their legal options or successfully navigate complex legal proceedings alone, especially when detained, without a specialized children’s rights attorney. Studies have shown that immigration judges are almost 100 times less likely to grant relief to unaccompanied children without counsel compared to those with representation.

 

Many of these children have already experienced severe trauma and violence, and they are at risk of further harm, exploitation, and trafficking. I urge you to speak out and take action against the termination of legal access for unaccompanied kids and reinstate the Unaccompanied Children Program.”
